What to Expect from the PERM Process: A Guide for Employers and Skilled Workers

For U.S. employers sponsoring foreign nationals for a Green Card, the first and most crucial step is the PERM labor certification. It’s a mandatory requirement in most EB-2 and EB-3 employment-based immigration cases, and a carefully managed process can significantly affect both approval success and overall timelines. Among the most frequently asked questions by both employers and foreign employees is: how long does it take? Understanding the PERM processing time is essential for effective planning and setting realistic expectations.

What Is the PERM Labor Certification?

The PERM process, officially known as Program Electronic Review Management, is overseen by the U.S. Department of Labor (DOL). It is designed to ensure that hiring a foreign worker will not adversely affect the wages and working conditions of U.S. workers. Before filing a Green Card petition, the employer must first test the U.S. labor market through recruitment and obtain certification from the DOL.

The certification verifies that:

  • No qualified, available, and willing U.S. workers applied for the job
  • The employer is offering a prevailing wage based on DOL standards
  • The job duties and requirements are aligned with business necessity and not tailored to the foreign worker

Only once the PERM is approved can the employer move forward with Form I-140, the immigrant petition, and eventually the adjustment of status or consular processing.

Factors That Affect PERM Processing Time

The overall PERM processing time varies depending on several factors, including:

  • Prevailing Wage Determination (PWD): This is the first step, where the employer requests a wage level determination from the DOL. It typically takes 2–4 months.
  • Recruitment Period: Employers must conduct a recruitment campaign for at least 30 days, plus an additional 30-day waiting period to receive U.S. applicants and evaluate responses.
  • PERM Filing and DOL Review: Once recruitment ends, the employer can file the ETA Form 9089 electronically. The DOL processing time for standard reviews ranges from 6 to 9 months.
  • Audits: If the DOL issues an audit (which is not uncommon), it can add 6 months or more to the timeline.

Altogether, a standard PERM case may take anywhere from 9 to 14 months. However, audits or delays in PWD can stretch the process well beyond a year.

Tips for Managing the PERM Timeline1. Start Early

The earlier employers begin the PERM process, the better. For employees on temporary work visas such as H-1B, timing is critical to avoid running out of status before reaching adjustment eligibility.

2. Work with an Experienced Attorney

A skilled immigration attorney can help navigate every step, from drafting accurate job descriptions to ensuring timely recruitment ads and audit-proof filing. Mistakes or omissions in any stage can result in denials or costly delays.

3. Monitor DOL Updates

The Department of Labor regularly publishes current processing times and backlogs. Staying informed can help you adjust your expectations and plan I-140 filings accordingly.

4. Prepare for Possible Audits

Though audits are often random, certain job requirements or inconsistencies can trigger closer scrutiny. Proper documentation and a clear recruitment record are essential to passing audits without delay.

After PERM Approval: What’s Next?

Once the PERM is certified, the employer can file Form I-140 with USCIS. From there, the applicant must monitor their priority date based on the visa bulletin. If the date is current, the applicant may immediately file Form I-485 (Adjustment of Status) or proceed with consular processing abroad. This second phase of the employment-based Green Card process can also take several months to complete.

Legal Guidance Makes the Difference

The PERM process is highly regulated, paperwork-intensive, and time-sensitive. Employers must walk a tightrope between compliance and efficiency. Foreign workers, meanwhile, are often counting on successful outcomes for long-term stability and family planning.

That’s why partnering with the right legal team is essential. Kulen Law Firm brings over 15 years of experience in handling PERM labor certifications, employment-based visa petitions, and long-term immigration strategies. Their team guides both employers and professionals through each step—ensuring timely, accurate, and compliant filings that keep your immigration goals on track.
